The Patent Trial and Appeal Board (PTAB) has become a political hot potato over the last several years—even more so than it has been at any time since its inception over a decade ago. Both Director Iancu and Director Vidal have taken a very hands-on approach to the PTAB, but with dramatically different results. Indeed, some have characterized the change at the Office as a “whiplash problem” that should be resolved with reforms by way of rulemaking.
